Terms and Conditions

These Terms and Conditions (“Terms”) govern the services provided by KY Bluegrass Landscaping (“Contractor,” “we,” “us,” or “our”) to the client (“Client,” “you,” or “your”) and are incorporated by reference into any agreement or estimate between the parties. By engaging our services, you agree to these Terms.
1. Scope of Work
1.1 The Contractor shall perform landscaping, lawn care, mowing, trimming, fertilization, weed control, hardscape work, cleanup, and related services as agreed in the written estimate or service agreement (“Services”).
1.2 Any work beyond what is described in the estimate or agreement is considered extra and will incur additional charges.
1.3 The Client shall provide access to the property and necessary utilities (water, electricity) unless otherwise arranged.
2. Payment Terms
2.1 Payment is due as specified in the agreement or invoice. Unless otherwise agreed, payment must be made within X days of invoicing (e.g. 15 days).
2.2 A deposit may be required before work begins (e.g. 30% of the estimated cost).
2.3 Late payments may incur interest or fees (e.g. 2% per month) on overdue balances.
2.4 The Contractor reserves the right to suspend work if payment is not made in accordance with these Terms.
3. Changes and Additional Work
3.1 If the Client requests changes or additions (change orders), the Contractor will submit a revised cost and timeline. Work will proceed only after Client approval.
3.2 Weather, site conditions, or unforeseen circumstances may require adjustments to scheduling or scope. The Contractor will notify the Client of delays or necessary modifications.
4. Termination
4.1 Either party may terminate the agreement by giving written notice (e.g. 30 days) prior to the termination date.
4.2 If terminated, the Client must pay for all work completed up to the termination date.
4.3 The Contractor may terminate immediately if the Client fails to comply with these Terms, including nonpayment or breach of duties.
5. Liability and Indemnification
5.1 The Contractor carries appropriate liability insurance; however, the Client must notify the Contractor of any special risks or conditions on site.
5.2 The Contractor is not liable for damage caused by factors outside its control (acts of nature, vandalism, underground utilities, etc.).
5.3 The Client agrees to indemnify and hold harmless the Contractor from claims, damages, losses, or liabilities arising from the Client’s negligence, misuse of property, or failure to disclose site conditions.
6. Warranty and Guarantee
6.1 The Contractor does not provide a warranty on plant materials, sod, or natural materials except as required by applicable law.
6.2 If any defects in workmanship are identified within X days (e.g. 30 days) after completion, the Contractor will correct them at no additional charge, provided that the Client has maintained the work properly.
7. Governing Law
These Terms shall be governed by and construed under the laws of the state in which the property is located (e.g. Kentucky). Any disputes arising under these Terms must be resolved in the appropriate state or local courts.
8. Entire Agreement
These Terms, along with the service estimate or agreement, constitute the entire understanding between the parties. Any modifications must be in writing and signed by both parties.
9. Severability
If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions shall continue in full force and effect.
